Starting 2 August 2026, individuals in the EU must be informed when they interact with an AI system or are exposed to certain AI-generated or manipulated content.
Specifically, providers are required to inform users when they interact with an AI system and to add machine-readable labels that enable the detection of AI-generated or manipulated content. Deployers must also inform individuals when they are exposed to deepfakes, AI-generated publications on matters of public interest, and systems for emotion recognition or biometric categorisation.
The EU Commission has now published draft guidelines on the transparency obligations under the AI Act (i.e. the AI Regulation). Stakeholders can submit their comments on these drafts until 3 June 2026. The purpose of the draft guidelines is to clarify the scope of the transparency obligations and to facilitate compliance for both providers and deployers. In addition, a voluntary code of conduct is being developed by independent experts and is expected to be available in June 2026.
